Terms of Use

1. Organiser

The organiser of “Spotlight 2016” is ‘Moto India’, a business unit of Motorola Mobility LLC (hereinafter referred to as "Moto").

2. Eligible participants

  • The contest is open to all residents of India except the employees and the family members of the organizer, its associate companies, its advertising and promotional agencies and its auditors /executing agencies and their associate companies. Minors are not allowed to participate in this contest.
  • There is no entry fee and no purchase necessary to enter this contest.

3. Participation

Users are required to fill the registration form on the website to submit an entry.

  • After a user submits an entry, the user entry will go under review.
  • Once approved, the entry will be officially registered and be displayed on the website.
  • Users can submit multiple entries across different categories.
  • The categories for entry submission are - Music, Films, Photography, Art.
  • Music - Users are required to submit a YouTube link of their track.
  • Film - Users are required to submit a YouTube link of their film.
  • Photography - Users are required to upload a photo in jpeg format. The jpeg submission should not be larger than 4 MB.  
  • ART - Users are required to upload a photo of their artwork in jpeg format. The jpeg submission should not be larger than 4 MB.   
  • While submitting an entry in any of the categories, users can to submit a link of their portfolio/page/website. This section is optional

4. Selection of winners

  • The winners shall be selected from all entries/participants that have declared their participation within the time frame of the contest and are eligible to participate.
  • Highest votes received by the participants is not the sole critetria for winning.
  • Selection of winners will be done through a preliminary filter followed by public voting and a final call taken by Moto Mentors.
  • The users can register and vote till 24th February 2017, 11:59 PM on the Spotlight 2.0 website.
  • After 24th February 2017, 11:59 PM, no further registrations or voting for the users will be permitted on the Spotlight 2.0 website.

5. Prizes

  • 3 winners selected from each of the 4 categories will work in the Indian avatar of the iconic “Hello Moto” video.
  • The decision of Moto India would be final and binding on all the participants and no clarifications would be issued to any participants for any of the decisions.

6. Publication

  • Moto India reserves the right to use all assets (content/images) that are created with respect to this contest.
  • Motorola India does not bear any responsibility for copyright violations or infringements of intellectual property carried out by the participants.
  • The entries would be the intellectual property of Moto India. The entries are meant to be used by Moto India for promotional and display purposes, and also for any other use as may be deemed appropriate for the initiative.
  • Motorola India does not bear any responsibility for copyright violations or infringements of intellectual property carried out by the participants.

7. Code of conduct

  • The entries must not contain any provocative, objectionable or inappropriate content.
  • Moto India reserves the right to cancel or amend all or any part of the contest and/ or the Terms & Conditions. However, any changes to the Terms & Conditions will be updated/ posted on the website. It would be the responsibility of the participants to keep themselves informed as per any changes in the Terms & Conditions stated for this.
  • Moto India will in no way be responsible for the authenticity of the entry submitted. In case someone files for plagiarism against any entry, the repercussions will have to be borne by the participant(s) and not Moto India.

8. Possibilities for termination

  • Entries found to be plagiarized and in violation of any provision of the Indian Copyright Act, 1957 will be disqualified, solely based on the discretion of Motorola India.

9. Responsibility and Disclaimers

  • At the time of entry and/or submission, the participants are deemed to have read, understood and agreed to the Terms and Conditions of the contest.
  • By participating in the contest, the participants and the Facebook/Twitter/Instagram users respectively agree that no claim shall be asserted against the organizer, its affiliates or any of its or their directors, officers, employees or agents in respect of any damage, rights, claims or actions of any kind whatsoever that may result from their participation in the contest and/or acceptance and enjoyment of the prizes.
  • Any legal proceedings arising out of the competition/ its entries/ winners shall be subject to local jurisdiction of Delhi state.
  • This contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or any other social network.

10. Miscellaneous

  • Any personal data provided by the participants will be used by the organizer for the purposes of: (a) verifying their identity; (b) administering the contest and evaluating the work; (c) contacting the participants for prize collection or otherwise in connection with the contest; and (e) achieving the intended results in connection with the transactions contemplated herein.
  • Personal data will be provided voluntarily by the participants through the social network platforms.
  • It is the organizer’s policy to protect the privacy of the participants and to respect their rights under all applicable privacy laws. Personal data collected by the organizer will not be sold, provided or transferred out of Moto India. Personal data will not be provided to third parties for direct marketing or purposes unrelated to the contest without prior consent of the participant concerned.
